Terms of Use

These terms govern your use of the Swim Dashboard mobile application ("the App") and the website at swimdashboard.com ("the Website"), operated by Cuedos AI ("we", "us", "our").

By downloading, installing, or using the App, you agree to these terms. If you do not agree, do not use the App.

1. The App

Swim Dashboard is a pool swimming analytics app that reads workout data from Apple Health and presents it in analysed form. The App is provided as-is during the beta period.

2. Beta Programme

During the beta period:

• The App is provided free of charge
• Features may change, be added, or removed without notice
• The App may contain bugs that affect data accuracy or availability
• We may end the beta programme at any time
• Beta access is provided via Apple TestFlight and subject to Apple's TestFlight terms

3. Eligibility

• You must be at least 16 years old
• You need an iPhone running iOS 18 or later
• You need an Apple Watch with swim tracking capability
• You must grant the App read access to Apple Health swimming data

4. Health Data

The App does not provide medical advice. All metrics, insights, performance ratings, training load indicators, and coaching suggestions are for informational and recreational purposes only.

• Do not rely on the App for medical decisions
• Heart rate zone analysis, training load, and fatigue indicators are estimates based on general formulas — they are not clinical measurements
• Consult a doctor before starting or changing an exercise programme
• Data accuracy depends on Apple Watch sensor accuracy, which we do not control

5. AI Coach Feature

The optional AI Coach uses Anthropic's Claude API to generate coaching responses. By using this feature:

• You acknowledge that AI-generated advice is not a substitute for professional coaching or medical guidance
• You provide your own Anthropic API key — we do not provide API access and are not responsible for Anthropic's service availability, pricing, or terms
• Aggregated swim metrics are sent to Anthropic's servers (see our Privacy Policy for details)
• AI responses may be inaccurate, incomplete, or inappropriate — use your own judgement

6. Your Responsibilities

• Keep your device and Apple ID secure
• Back up your data regularly (the App stores data locally; if you lose your device, local data may be lost)
• If you use the AI Coach, keep your API key confidential
• Do not attempt to reverse-engineer, decompile, or extract source code from the App

7. Intellectual Property

The App, its design, code, and content are owned by Cuedos AI. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

Your swim data belongs to you. The App does not claim any ownership of data you generate through swimming.

8. Data Export

The App allows you to export your data in CSV, JSON, and PDF formats. Once exported, you are responsible for the security and storage of those files.

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the App will be error-free, uninterrupted, or accurate
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App
• Our total liability is limited to the amount you paid for the App (which is zero during the beta)

10. Data Accuracy Disclaimer

Swimming metrics displayed in the App (pace, distance, heart rate, SWOLF, personal bests, training load, streaks, and insights) are derived from Apple Watch sensor data and processed using general-purpose algorithms. These figures are estimates and may not match official timing systems, clinical measurements, or other tracking devices.

11. Termination

We may suspend or terminate your access to the App at any time, for any reason, without notice. Upon termination, your licence to use the App ends immediately. Your locally stored data remains on your device.

12. Changes to These Terms

We may update these terms when the App changes. Continued use after changes constitutes acceptance. Material changes will be communicated via the App or email.

13. Governing Law

These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Apple's Standard EULA

When the App is distributed via the App Store, Apple's Licensed Application End User License Agreement also applies.
